Article 4 Contractor
The intention of the Documents is to include all labor, materials equipment and other items as provided in Subparagraph 4.4.1 necessary for the proper execution and completion of the Work, and also to include all work which may be reasonably inferable from the Contract Documents as being necessary to produce the intended results. Words which have well-known or technical or trade meanings are used herein in accordance with such recognized meanings.
Article 4 Contractor
4. 5. 1 The Contractor warrants AND GUARANTEES to the Owner and the Architect that all materials and equipment incorporated in the Project will be new unless otherwise specified, and that all Work will be of good quality, free from faults and defects and in conformance with the Contract Documents. All Work not so conforming to these standards may be considered defective BY THE OWNER OR THE ARCHITECT. If required by the Architect, the Contractor shall furnish satisfactory evidence as to the kind and quality of materials and equipment.
5. 5. 2 The WARRANTIES AND GUARANTEES Warranty provided in this Paragraph 4.5 AND ELSEWHERE IN THE CONTRACT DOCUMENTS shall be in addition to and not in limitation of any other warranty OR GUARANTEE or remedy required by law or by the Contract Documents.
6. 7. 2 The Contractor shall give all notices and comply with all laws, ordinances, rules, regulations and orders of any public authority bearing on the performance of the Work. If the Contractor observes that any of the Contract Documents are at variance therewith in any respect, he shall promptly notify the Architect in writing, and any necessary changes shall be adjusted by appropriate Modification. If the Contractor performs any Work knowing it to be contrary to such laws, ordinances, rules and regulations, and without such notice to the Architect, he shall assume full responsibility therefore and shall bear all costs attributable thereto.
7. 8. 1 The Contractor shall include in the Contract Sum all allowances stated in the Contract Documents. These allowances shall cover the net cost of the materials and equipment delivered and unloaded at the site, and all applicable taxes. The Contractor's handling costs on the site, labor, installation costs, overhead, profit and other expenses contemplated for the original allowance shall be included in the Contract Sum and not in the allowance. The Contractor shall cause the Work covered by these allowances to be performed for such amounts and by such persons as the Architect may direct. But he will not be required to employ persons against whom he makes a reasonable objection. If the cost, when determined, is more than or less than the allowance, the Contract Sum shall be adjusted accordingly by Change Order, which will include additional handling costs on the site, labor, installation costs, overhead, profit and other expenses resulting to the Contractor from any increase over the original allowance.
8. 9. 1 The Contractor shall employ a competent superintendent and necessary assistants who shall be in attendance at the Project site during the progress of the Work. The superintendent AND ASSISTANTS shall be satisfactory to the Architect, and shall not be changed except with the consent of the Architect, unless the superintendent proves to be unsatisfactory to the Contractor and ceases to be in his employ. The superintendent shall represent the Contractor and SHALL HAVE FULL AUTHORITY TO ACT ON HIS BEHALF. ALL all communications given
