The judgement shall apply until such time as the Defendant is a member in good standing of the National Concrete Masonry Association and entitled to full privileges of membership. The patent and trademark protection for SHADOWAL Block involves both the manufacture and sale of this product and belongs exclusively to NCMA and its members. Since SHADOWAL Block was introduced in 1956, however, some firms engaged in the production and sale of the SHADOWAL have dropped their membership while others have never been members of NCMA. The Borgert firm has not been an NCMA member since 1961 and had continued to make and sell SHADOWAL Block until the recent court action was concluded.
